These Terms of Service ("Terms") govern your access to and use of ShipMate (the "Service"), available at shipmate.so. By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.
ShipMate is operated by Simon Smaluhn and Jan Tammen (collectively, the "ShipMate team," "we," "us," or "our"). For any questions related to these Terms, email info@shipmate.so.
ShipMate is a content-generation tool that helps you turn work logs, GitHub commits, and other activity into platform-specific social-media posts written in your own voice. You provide the inputs (work logs, writing samples, optional repo connections); we generate AI-assisted post drafts. You always review and approve content before anything is published.
The Service includes optional connections to third-party platforms (LinkedIn, X/Twitter, Instagram, Facebook, WordPress, Substack, Mailchimp). When you connect one, you authorize ShipMate to publish content you approve to that destination on your behalf. The third-party platform's own terms continue to apply.
You own everything you put into ShipMate. Your work logs, writing samples, generated drafts that you approve, repo data we read with your permission, and any imported social-media posts remain yours.
By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and modify your content solely for the purpose of providing the Service to you. This license ends when you delete the content or your account, except for backups (which are purged on the schedule described in our Privacy Policy) and for content you have already published to third parties - that content lives in those destinations independently of ShipMate.
You represent that you have the rights to all content you submit. Don't paste someone else's writing samples and ask us to imitate their voice without their permission.
ShipMate uses AI models (currently Google Gemini and Groq, may change as we improve the product) to generate post drafts based on your inputs and style profile. AI output can be inaccurate, biased, or contain errors. You are responsible for reviewing every generated post before approving and publishing it. ShipMate is not liable for the substance of content you publish, even if generated by our AI.
Outputs generated for you are yours to use, edit, publish, or discard. We don't claim ownership over what the AI produces for you. We don't train external AI models on your private content; AI providers we use process content per their own data-use agreements (see Privacy Policy subprocessor list).
Don't use ShipMate to:
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity. We don't refund violations.
When you connect ShipMate to a third-party platform (e.g. LinkedIn for posting, GitHub for repo monitoring, Stripe for billing), you also agree to that platform's terms of service. We are not responsible for third-party platform outages, policy changes, or actions taken by those platforms against your account there. The current list of third parties we integrate with is in our Privacy Policy.
We aim for high availability but do not guarantee 100% uptime. The Service is provided "as is" and "as available." We may add, modify, or remove features at any time. For material changes that affect existing functionality you depend on, we'll give at least 30 days' notice via email or in-app announcement. If we discontinue the Service entirely, we'll provide at least 60 days' notice and a way to export your data.
ShipMate's code, design, branding, prompts, and AI workflows are our property (or licensed to us). These Terms don't grant you any ownership in the Service itself. The ShipMate name and logo are our trademarks; don't use them in a way that implies endorsement without our permission.
How we collect, store, share, and protect your data is described in our Privacy Policy, which is part of these Terms. Read it.
You can terminate by deleting your account in Settings → Account. All your data is removed within 30 days (see Privacy Policy retention schedule), and you stop being billed at the end of the current period.
We can terminate or suspend your account immediately for material breach of these Terms (notably the Acceptable Use rules), legal reasons, or extended non-payment. Where reasonable and permitted, we'll give you notice and a chance to cure the issue first.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't warrant that the Service will be uninterrupted, error-free, secure, or that AI outputs will be accurate. To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE SHIPMATE TEAM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE - even if we have been advised of the possibility of such damages.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 100. Some jurisdictions don't allow these limitations; in those cases, this section applies to the fullest extent permitted.
You agree to indemnify and hold the ShipMate team harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to: (a) content you submit, generate, or publish via the Service; (b) your violation of these Terms or applicable laws; (c) your violation of third-party rights, including intellectual property rights. We'll notify you of any such claim and may participate in the defense at our own cost.
We may label some features as "beta," "preview," "SLC," or similar. Beta features are provided as-is, may change or be removed without notice, and are excluded from any uptime expectations. Use of beta features is at your own risk.
These Terms are governed by the laws of the Republic of Indonesia, where the ShipMate team operates, without regard to conflict-of-laws principles.
For any dispute, we encourage you to first contact us at info@shipmate.so so we can try to resolve it informally. If informal resolution fails, disputes will be resolved in the courts of Bali, Indonesia, except where applicable consumer protection law in your country of residence requires a different forum.
We may update these Terms as the Service evolves. Material changes will be announced via email and/or in-app notice at least 14 days before they take effect; the "Last updated" date at the top reflects the most recent revision. Continued use of the Service after changes go into effect means you accept the new Terms. If you don't agree, your remedy is to stop using the Service and (if applicable) cancel your subscription.
